During the Helena City Commissions discussion of the proposed ordinance and as reported in the meeting minutes, Helena City Attorney Thomas Jodoin reported to the Commission members that the sale of flavored tobacco being limited to establishments where only adults are allowed may be challenged on the basis that the city does not have the authority to regulate flavored tobacco products or where such products may be sold. After public comment on the ordinance, the ordinance was amended to delete the provision banning the retail sale of flavored tobacco products
