(c) Beginning in 2009 and in successive years thereafter, the Office of the United States Trade Representative shall publish in the Federal Register a determination for that calendar year, using the most recent annual data available, of the amount of the trade surplus (the amount by which Peru's exports to all destinations exceeds its imports from all sources), by volume, for goods of Peru under the terms of general note 32 to the tariff schedule, that are classified in the following subheadings: 1701.12, 1701.13, 1701.14, 1701.91, 1701.99, 1702.40 and 1702.60, except that Peru's exports to the United States of goods classified under subheadings 1701.12, 1701.13, 1701.14, 1701.12, 1701.91 and 1701.99 and its imports of originating goods of the United States classified under subheadings 1702.40 and 1702.60 shall not be included in the calculation of Peru's trade surplus
